These Terms govern your use of CardTracker (the "Service"), operated by Sink or Swim Inbound Marketing Limited, a company registered in Ireland (company number 5141805), registered office at 70 Charlesland Wood, Greystones, Wicklow, A63 AE79, Ireland ("CardTracker", "we", "us"). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
CardTracker monitors publicly available listings on Cardmarket for Pokémon cards you choose to track, and sends you alerts about new listings and price changes. The Service is informational only. We do not sell cards, we do not buy cards on your behalf, and we are not a marketplace.
CardTracker is independent and is not affiliated with, endorsed by, or sponsored by Cardmarket, Nintendo, The Pokémon Company, Creatures Inc., or Game Freak. All trademarks belong to their respective owners.
The Service is currently in beta and provided free of charge. Features may change, break, or be removed, and availability is not guaranteed during this period.
We work hard to keep data accurate and timely, but listings change constantly and we cannot guarantee that any information is complete, current, or error-free. Nothing in the Service is financial, investment, or trading advice. Any buying decision you make is your own.
You agree not to misuse the Service, including attempting to disrupt it, reverse engineer it, resell or redistribute its data, or use it for any unlawful purpose. You are responsible for complying with the terms of any third-party site (including Cardmarket) when you act on our alerts.
When account features launch, you are responsible for keeping your login details secure and for activity under your account. You must provide accurate information and be old enough to form a binding contract under Irish law.
The Service is free during beta. Paid plans may be introduced later, with clear notice beforehand. When paid plans launch, applicable fees, billing, and cancellation terms will be presented at sign-up.
To the maximum extent permitted by law, CardTracker is provided "as is" and we are not liable for any indirect or consequential loss, lost profits, or missed opportunities arising from your use of, or inability to use, the Service.
You may stop using the Service at any time. We may suspend or end access if these Terms are breached or if we discontinue the Service.
We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes means you accept the updated Terms.
These Terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction over any dispute.
